When parents separate, North Carolina courts focus on one core question: what costodial arrangement is in the best interests of the child(ren).

The law recognizes two main kinds of custody:

  • Legal custody – Legal Custody refers to  a parent’s rights to make major decisions on behalf of the child, such as  education, medical care, and religion. North Carolina courts can award parents joint legal custody, or grant one parent sole legal custody
  • Physical custody – Physical Custody determines where the child lives and how time is divided between the parents. North Carolina courts can award primary physical custody, joint physical custody, or sole physical custody.

“Sole custody” of both types is uncommon and usually reserved for situations involving serious safety or stability concerns.

How Courts Look at Custody

North Carolina law does not presume that one parent is automatically better suited for custody than the other. Courts start from a neutral position and base custody decisions on the best interests of the child(ren). North Carolina courts do not automatically favor mothers over fathers or the higher earning parent. Child support is available to help ensure a child’s needs are met when there is an income difference between households.

When determining custody, North Carolina judges consider practical, child-focused factors including but not limited to:

  • The child’s relationship with each parent
  • Each parent’s ability to provide a safe, stable, and nurturing home
  • The child’s daily routines, school needs, and overall well-being
